Single Joint Expert and Party Expert Support
Whilst many of our instructions in matrimonial matters tend to be as Single Joint Expert (SJE), we also regularly act as both party expert and as party advisor/ shadow expert where there is an SJE or the parties want to resolve matters without appointing one. We have also been involved in matters which are being settled by mediation, attending mediation meetings to explain valuation issues.
Experienced Matrimonial Expert Witnesses
All our forensic accounting managing directors are highly experienced in acting as expert witness and have given evidence under cross-examination on numerous occasions. We are also conscious of the particular sensitivities that can be present in family law cases and approach matters in a robust but sensitive manner, particularly when meeting or speaking with the parties. Our reports are written to present complex financial issues in an easy to understand format, assisting spouses with the settlement process.
Business and Share Valuations in Matrimonial Disputes
Much of our work in matrimonial matters involves us valuing shareholdings, companies, businesses and partnerships. Our team has valued thousands of businesses across most industry sectors. We have significant experience in valuation matters, including the valuation of more complex financial instruments and structures such as share options and growth shares and interests in private equity businesses (See our Business Valuations page for more information) and have undertaken valuations of thousands of businesses across most industry sectors and of all sizes.
We also comment on tax, liquidity and sustainable income as these factors are key to resolving matrimonial disputes.
Financial Disclosure and Form E Reviews
Where parties are hoping to avoid appointing an SJE, or in advance of that process, we are instructed to provide guidance on Form E disclosures, reviewing information that has been included by one of the spouses and identifying any shortcomings or questions that should be asked. This can include reviewing shareholdings, company accounts, bank statements and other financial documentation. We are regularly instructed to review publicly available financial information in order to identify matters that may not be readily identifiable from financial disclosure.
Pre-Nuptial and Post-Nuptial Agreement Valuations
We also advise on pre-nuptial or post-nuptial agreements, for example, where clients require a contemporaneous valuation of assets to be undertaken.
